Successful Court Order to Release Long Form Birth Certificate in New York State

My client was in need of a long form copy of his grandfather’s birth certificate on short notice, since he had an upcoming dual citizenship appointment with the Italian consulate in New York City in April of 2025. Time was of the essence and I brought the case in such a way to expedite it. My client was able to get what he needed in hand, with plenty of additional time for Italian translation and apostille. He was able to submit the necessary documentation to the Italian consulate in New York City through the mail prior to his appointment date.

Dual Italian citizenship jure sanguinis, via right of blood, has been a trending topic for years. More recently it has been in the headlines because Italy has recently curtailed dual citizenship requirements. Previously, descendants were able to go back an unlimited number of generations and be recognized as Italian citizens, provided a direct ancestor was alive on or after March 17, 1861. Now, as a result of a decree that was enacted on March 28, 2025, which has since become final law after the 60 day parliamentary period, descendants are limited to going back 2 (two) generations. Applicants must have either a parent or grandparent who was born in Italy. Regarding my client in the instant case, the new decree was passed just shortly before his existing appointment date with the consulate, and he is still able to pursue his claim through a great-grandparent born in Italy. Pursuant to the final law, anyone that had an existing appointment would be subject to the previous requirements, which did not limit the number of generations one can go back.
