CIVIL LITIGATION

Civil litigation is a legal process between two or more parties that occurs outside of a criminal context. This is the civil justice system. The relief sought is often money damages, but there are other forms of relief. For instance, restraining orders and injunctions. Civil litigation runs a wide gamut. These types of cases include personal injury cases, commercial contract cases, money disputes, property disputes, Article 78 proceedings, etc…

The party suing is called the Plaintiff, while the party being sued is called the Defendant. In New York State, the Supreme Court of the State of New York is the trial level court. The Appellate Division is the first level appeals court. The New York State Court of Appeals is the highest level court in the state, which hears appeals of decisions of the Appellate Division.
